Difference Between cognizable and non-cognizable offence
There are following distinction between cognizable and non-cognizable offences
- Cognizable offences are serious offences while non-cognizable offences are moral in nature.
- In a cognizable offence, the police officer is empowered to arrest the offender without warrant whereas in non-cognizable offence, police may not arrest to the offender without warrant.
- In cognizable offence, the police may arrest without warrant but also has a duty to investigate the matter while in non-cognizable offence, police cannot investigate into the matter without warrant of magistrate.
